Build an exposure and medical chronology
Record substances or product identifiers actually known, tasks, dates, locations and employers. Safety data and hazard-communication information can help identify the exposure, but do not collect hazardous samples or access restricted materials. OSHA 29 CFR 1910.1200 — hazard communication · 19 Del. C. § 2304 — compensation and employer remedy
Keep medical diagnoses, test records and what clinicians said about possible causes. A workplace substance and a later diagnosis are not enough by themselves to establish legal or medical causation. Relevant non-work history should be disclosed honestly. OSHA 29 CFR 1910.1200 — hazard communication · 19 Del. C. § 2304 — compensation and employer remedy
Occupational disease has separate notice and filing
Under § 2342, occupational-disease written notice generally has a six-month employment-connection knowledge framework, subject to the statute’s actual-knowledge provision. This differs from accident notice. 19 Del. C. §§ 2341–2342 — accident and disease notice · 19 Del. C. § 2361 — filing provisions
Section 2361 supplies separate occupational-disease and ionizing-radiation filing provisions involving knowledge of an employment connection. Do not treat notice, diagnosis, a medical visit and a Board filing as interchangeable steps. The exact history and statutory qualifications require counsel review. 19 Del. C. §§ 2341–2342 — accident and disease notice · 19 Del. C. § 2361 — filing provisions
Products, releases and another business
A supplier, contractor or other business may require investigation if its conduct contributed. Identify product history, responsibility for the task and which company controlled the relevant condition. Hazard classification is not itself proof of negligence. 19 Del. C. § 2363 — third-party claims and reimbursement · OSHA 29 CFR 1910.1200 — hazard communication
Coordinate compensation history with any separate settlement. Ask about reimbursement and what the proposed release resolves. A safety report does not automatically preserve every civil or benefit deadline. 19 Del. C. § 2363 — third-party claims and reimbursement · OSHA 29 CFR 1910.1200 — hazard communication
Which claim path needs review?
| Situation | Question to investigate | What can change it |
|---|---|---|
| Covered employee injured at work | Workers’ compensation benefits | Employment, causation, exclusions and timely procedures |
| Another company contributed | Separate third-party responsibility | Legal relationship, immunity, fault and reimbursement |
| Qualifying railroad employment | Federal FELA assessment | Covered carrier, duties, negligence and proper forum |
19 Del. C. § 2304 — compensation and employer remedy · 19 Del. C. § 2363 — third-party claims and reimbursement
